Connecticut investigators submitted a report consisting of more than 600 pages that stated that no one would face criminal charges in connection to a fatal crash. The wreck occurred along I-84 last year. Even though no drivers will be charged, circumstances could potentially point to the trooper’s death being considered a wrongful death.

There were several factors that contributed to the deadly wreck. According to the investigators and several witnesses, the veteran officer had worked a double shift and was reportedly noticeably tired. He was still on duty at the time of the crash. A bus driver reported that the officer was traveling at a high rate of speed without his emergency lights as he merged onto the interstate. Moments after merging, his cruiser crashed into the rear of a tractor-trailer.

The force of the impact killed the officer. The trucker was uninjured in the collision and was reportedly traveling at a speed that significantly increased the probability of causing an accident. According to the driver, his truck experienced a recurring mechanical problem that led to him losing power when traveling uphill. The report indicated that the trooper attempted to brake and swerve to avoid hitting the slow-moving vehicle but was unsuccessful.

This particular truck had experienced this mechanical malfunction before, and the driver claimed that he was attempting to pull onto the breakdown lane when the crash occurred. Along with the power loss — which tests were able to reproduce — the trucker apparently removed pages from his driving log. This driver reportedly had previous violations for logbook discrepancies. Though Connecticut officials have concluded that this fatal wreck was an accident, they did state that poorly maintained trucks pose a hazard to fellow travelers. Survivors of victims who have died as a result of equipment failure may have a basis for filing a wrongful death civil suit to seek recovery of financial losses and to hold companies accountable for their losses.
