Family might consider wrongful death suit after fatal crash

The Memorial Day weekend unofficially marks the beginning of summer and an increase in traffic along Connecticut highways and parkways. It can also end in tragedy if drivers do not exercise due diligence at all times. Now one family may consider the merits of filing a wrongful death suit after a fatal wreck robbed them of their loved one.

The crash occurred in the late afternoon on the Saturday of the holiday weekend. The victim, a 44-year-old man was driving south along the Wilbur Cross Parkway in the right hand lane. A driver headed north was purportedly traveling at a high rate of speed in the left hand lane of the opposing side.

That driver, a 21-year-old, apparently lost control of the vehicle. It traveled across the verge and collided with the victim’s automobile. The impact caused the first driver to lose control and his vehicle careened down an embankment. Rescue crews found that he had been thrown from his SUV and killed at the scene.

The second driver was also partially thrown from his car, and he was transported for treatment of injuries not considered life-threatening. Connecticut officials have not completed their investigation. It is unknown what charges — if any — the driver may face in light of this fatal wreck. The family of the victim may choose to consult with a personal injury attorney in order to ascertain whether to file a wrongful death civil suit against the surviving driver. Though the victim was not using his safety restraint, Connecticut is a comparative negligence state, and the wreck would not have occurred had the other driver not lost control.
