Negligent driver who fled the scene may face wrongful death claim

On Behalf of | Sep 28, 2016 | Wrongful Death |

A man who is suspected of causing a fatal Connecticut crash and then fleeing the scene was subsequently arrested. Leaving the scene of an accident in which injuries or fatalities occurred is illegal. Regardless of whether a person drives away from the scene or flees on foot, he or she will likely face criminal charges and may also be sued for wrongful death or personal injury in civil court .

This crash occurred in East Haven on a recent Wednesday afternoon. Reportedly, a car that was occupied by the driver and two passengers smashed into a pole. A 27-year-old female passenger died at the accident scene, and another woman suffered serious injuries. She was rushed to a hospital for treatment.

When authorities arrived at the scene, the driver was missing. A picture of the missing man was published, and sightings in the wooded area near Dunkin’ Donuts were reported. Police located and arrested the 23-year-old man three days later. He is now facing several charges, including feeling an accident scene and causing death and serious injury through negligent vehicle operation.

Even if an individual killed or injured in a crash was a passenger in the car of a negligent driver, that driver may be held accountable for losses in a Connecticut civil court. Personal injury and/or wrongful death claims may be filed to pursue recovery of damages. After negligence has been established by appropriate evidence, the court will adjudicate documented claims for financial and emotional damages that were brought about by the accident. This typically results in a monetary judgment
