Car accidents: Elderly pedestrian killed in Connecticut

A Connecticut man recently lost his life when he was struck by a car. Car accidents that involve pedestrians are often fatal, and many of the crashes involve factors like speed, impairment or distraction. However, pedestrians who fail to use crosswalks may be partly to blame.

According to an accident report, a 56-year-old Bristol driver of an SUV was southbound when he struck the pedestrian in front of the police department. The pedestrian was a 77-year-old man who was busy crossing the street when the car knocked him down. The SUV driver suffered no injuries and remained at the scene of the accident to cooperate with authorities.

Reportedly, the pedestrian suffered a critical injury to his head. He survived only until early the next morning when he succumbed to the injuries. The accident investigation is ongoing. Authorities said they would be looking at various aspects related to the incident, including the condition of the road, the SUV driver's speed at the time of the crash, the right of way and more.

The surviving family members of the deceased man may be entitled to file a wrongful death claim in a Connecticut civil court. However, police were unsure whether the pedestrian crossed in the crosswalk or the vicinity of it. The modified comparative negligence law may come into play by which the court typically determines the percentage fault of all parties involved in car accidents. It will determine whether the deceased man was at fault to any percentage. So long as any negligence on the part of the victim was less than 51 percent responsible for the accident, his surviving family may be entitled to financial relief in civil court.
